Terms of Use

Welcome to Yito! As we kick-start the journey of creative innovation together, it's important to establish a clear understanding of our working relationship. Please read these terms and conditions carefully as they form the basis of our subscription service agreement.

1. Acceptance of Terms

By subscribing to our services, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions. If accessing our services on behalf of a company or other legal entity, you confirm that you have the authority to agree to these terms on behalf of that entity.

2. Collaboration and Communication

2.1 Single point of contact: The client agrees to appoint a single point of contact for the duration of the project. This individual will be responsible for consolidating all stakeholder feedback and approvals, ensuring efficient and clear communication between your team and Yito.

2.2 Adding an additional point of contact: Yito offers the flexibility to add an additional POC for a fee of £49 per month. This option allows another team member to directly engage with Yito, providing an extra layer of collaboration and insight into your projects.

2.3 Timely feedback: To keep the momentum of your projects and make the most of our subscription model, the client commits to providing feedback in a timely manner. This ensures projects move forward smoothly and are completed within expected timelines.

3. Subscription Services and Exclusions

Yito offers a comprehensive suite of creative services designed to meet your design, development, and copywriting needs with a unique monthly fee structure. However, it's important to note certain exclusions:

3.1 Exclusion of Third-Party Costs: The subscription fee covers our core services but does not include costs associated with translation, localisation, or internationalisation. Additionally, our service is tailored for effectiveness in a single original market and may not include adaptations for other markets without further agreement.

3.2 Subscription Add-Ons:

Our commitment at Yito extends beyond providing essential creative services; we aim to accommodate your project's unique demands and growth phases. While our subscription encapsulates a wide array of core services, we recognise the evolving needs of your projects. To this end, we offer specialized subscription add-ons:

3.2a Yito Boost: Designed for times when your project demands escalate, particularly during large campaigns. This add-on allows you to double your request capacity for one week, ensuring robust support for your most critical times.

Cost: £699 per week

3.2b Custom Web App Development: Tailored web development is pivotal for certain projects. Our expertise in JavaScript-based frameworks like React.js and Node.js is available through this add-on, catering to your custom web application development needs. This specialised service, requiring specific expertise and resource allocation, is offered exclusively as an add-on. This ensures that projects necessitating bespoke development receive the focused attention and expertise required to deliver high-quality, customised solutions.

Cost: £499 per week

3.2c Dedicated Comms: To streamline communication, we offer integration with your team via Slack or Microsoft Teams. This dedicated channel ensures seamless interaction with our team, enhancing project coordination and efficiency.

Cost: £99 per month

3.3 Content creation and licensing: Costs related to photography, art buying, image rights, and any activities or services related to content creation, acquisition, or licensing are not included in the subscription. Clients should ensure they have the necessary rights to any materials provided for use in projects.

4. Intellectual Property Rights

Upon final payment, all creative work produced under your subscription becomes your intellectual property. However, Yito retains the right to showcase completed projects for promotional purposes unless otherwise requested.

5. Payment, Cancellation, and Renewal

Subscription fees are billed monthly, providing you continuous access to Yito's innovative design, development, and copywriting services. To maintain the high-quality service and dedicated support you expect from us, it's crucial that these subscriptions are managed promptly. Here's how it works:

5.1 Monthly billing: Your subscription fee ensures your projects are always in the hands of our expert team, ready to bring your visions to life with efficiency and creativity.

5.2 14-Day guarantee: We're here to make sure Yito is the perfect fit for your creative needs. If you're not completely satisfied within the first 14 days of your subscription, you have the option to cancel and receive a full refund, no questions asked. However, it's important to note that refunds are not offered within the current billing cycle after the initial 14-day period.

5.3 Flexible management: Through your custom client portal or with the help of our supportive team, you can pause or cancel your subscription at any time. This flexibility is part of our commitment to adapt to your evolving business needs.

5.4 On hold for non-payment: In the event that a subscription payment is delayed or missed, we must pause all ongoing and upcoming work. All tickets will be put on hold until the payment is received. This policy ensures fairness and dedication to our active clients. Rest assured, once payment is confirmed, we will promptly resume work on your projects, aiming to minimise any disruption to your planned timelines.

5.5 Communication and support: We understand that sometimes, unforeseen circumstances can affect timely payment. We encourage open dialogue about any potential delays in payment - our team is here to work with you to ensure your subscription and projects continue smoothly.

5.6 Termination & Post-Termination Access: The agreement may be terminated by either party under specific conditions. Upon termination, all ongoing projects will be finalised in accordance with the terms outlined in the last billing cycle. Please note, access to the client portal will be revoked 90 days following termination. Additionally, your files and project data will be archived and retained, allowing for the possibility of contract renewal or reconsideration at a future date.

6. Limitation of Liability

We pride ourselves on the quality and reliability of our services, yet unforeseen circumstances may arise. Yito's liability is limited to the fullest extent permitted by law, ensuring that neither party is liable for indirect damages or lost profits.

7. User Responsibilities and Conduct

You're expected to provide accurate information, use Yito's services ethically, and comply with all relevant laws. Misuse may lead to suspension or termination of your subscription.

8. Privacy and Data Protection

We are committed to protecting your privacy and personal data, adhering to data protection laws. Our privacy policy details how we handle your information.

9. Warranty and Disclaimers

Yito's services are provided "as is," without specific guarantees on outcomes. We limit our liability to the amount paid in the last billing cycle for direct damages.

10. Dispute Resolution

Disputes should first be attempted to resolve amicably. If unresolved, arbitration will take place under the laws of our jurisdiction, with both parties agreeing to the outcome.

11. Amendments to Terms

These terms may be updated to reflect changes in our services or legal requirements. We encourage you to review them regularly. Continued use of Yito's services after any updates means you accept the new terms.
